Habersham attorney facing felony charges

CLARKESVILLE – A Habersham County attorney faces a number of felony charges following an undercover operation by the Georgia Bureau of Investigation in late November.

Jerry Bruce Harkness Sr., 49, of Demorest was arrested Friday on a dozen warrants issued by Georgia Senior Superior Court Judge Stephen E. Boswell.

Charges include six counts of distribution of a Schedule II controlled substance in violation of Georgia law, and six counts of use of a communication facility to commit a felony.

Warrants taken by GBI Regional Drug Enforcement Office Assistant Special Agent in Charge Ken Howard state five of the incidents happened at Harkness’ office, 700 Central Ave., Demorest. The sixth incident occurred in the parking lot of a fast food restaurant in Cornelia.

According to the warrants, Harkness distributed hydrocodone pills without lawful authority the afternoons of Nov. 20, 21, 23, 25, 26, and 28, using his cellular phone to facilitate that distribution.

Harkness, who operates The Harkness Firm in Demorest, was admitted to the State Bar of Georgia on June 30, 1997. He attended Atlanta’s John Marshall Law School, and his practice is a member of the following sections of the State Bar: criminal, general practice and trial law, and tort and insurance law.

As of Friday, Harkness was listed as an “active member in good standing” on the State Bar of Georgia’s website. The site also shows no public disciplinary history for Harkness.

A certificate of organization for Harkness Law Firm LLC, a Domestic Limited Liability Company, was filed with Georgia Secretary of State Brian Kemp’s office on Oct. 30, 2012.

Harkness formerly served as a member of the Demorest City Council, a position he resigned in 2011 to run for the Georgia House District 10 seat.

Harkness was arrested by the GBI and was booked at the Habersham County Detention Center in Clarkesville. Bond on the charges was set at $50,000.
